Australian Trade Mark Filing Requirements

There are no forms in Australia, New Zealand, Singapore or Hong Kong that require the applicant’s signature at the time of filing. No Power of Attorney is required. In order to file a trade mark application in Australia, the following information is required:

Representation Of The Trade Mark

While no representation is required for a plain word trade mark, an example of device or logo marks in PNG (.png), TIFF (.tif), JPEG (.jpeg, .jpg) is required. Sound marks should be in MP3 (.mp3) or MPEG (.mpg) format and animated files must be in MPEG (.mpg) format. If the proposed trade mark includes a language other than English, a translation / transliteration is required.

Applicant Details

The applicant’s full name and address (including country of incorporation if applicable).

Goods/Services

A statement of the goods or services in relation to which the trade mark is used or proposed to be used to enable identification of the appropriate class/es to be covered by the application.

Convention Priority Claims

In the case of an application claiming convention priority, the number(s), date(s) and country of filing of the priority application.
