Designs Validity

If your registered design is being copied, we can help you to assert your rights against an infringer.

If you are concerned that products you are making or selling may infringe a registered design, there are options for having the registration revoked. A challenge can be made pre-emptively or in response to being sued for infringement.

Third-party observations

It is possible for anyone to provide information to IP Australia that is relevant to the validity of a registered design, such as evidence relating to prior-published designs.

Design examination

A third party can request IP Australia to examine a registered design to test its validity. This can be done even if the design has already been examined and certified previously. IP Australia may also choose to conduct examination of its own volition, typically in response to third-party observations.

Design revocation proceedings

These are commenced in the court, either preemptively or as a counter-claim in an infringement suit, seeking to revoke the registered design alleged to have been infringed.
